We have written this document in plain language because we believe legal disclosures should be readable, not performative. It explains how we handle information shared with the foundation, the terms under which this site is made available, and the limits of what visiting it implies.

Introduction
The T. James Foundation, Inc. ("we," "us," or "the Foundation") respects the privacy of visitors to our website at tjamesfoundation.org (the "Site") and the limited audiences with whom we correspond. This Privacy Policy explains what information we collect, how we use it, and the choices available to you. By using the Site, you agree to the practices described here.
We are a private family foundation, not a commercial business. We do not sell products, run advertising, or trade in personal data. The information we collect is limited to what is required to operate the Site and respond to those who choose to contact us.
Information We Collect
We collect two categories of information:
Information you provide to us. When you contact the Foundation by email or through any contact channel listed on the Site, we receive your email address, your name (if provided), and the contents of your message. We may retain this correspondence for our records.
Information collected automatically. When you visit the Site, our servers and any analytics services we use may automatically collect basic technical information such as IP address, browser type, device type, referring URL, and pages viewed. This information is used to operate and improve the Site.
How We Use Information
We use the information we collect to:
- Respond to inquiries and correspondence directed to the Foundation.
- Operate, maintain, and improve the Site and its content.
- Comply with legal obligations applicable to private foundations, including recordkeeping required by the Internal Revenue Service.

We do not sell, rent, or trade personal information. We do not share information with advertisers or marketing services. We may share limited information in three specific circumstances:

- Mission-related correspondence. If you contact us as a representative of an organization, we may share your correspondence with our trustees as part of our normal grant review process.
Cookies and Tracking
The Site may use a small number of essential cookies and similar technologies necessary for the Site to function. We do not use cookies for advertising or third-party tracking purposes. Most browsers allow you to refuse or delete cookies through their settings.
We may use a privacy-respecting analytics service to understand aggregate Site usage. We do not use analytics services that build cross-site profiles of individual visitors.
Data Security
We take reasonable technical and organizational measures to protect the information we hold, including encryption in transit, access controls, and limited retention. No method of transmission over the internet is fully secure, however, and we cannot guarantee absolute security. You share information with the Foundation at your own discretion.
Your Rights
Depending on your location, you may have rights regarding your personal information, including the right to access, correct, or request deletion of information we hold about you. Children's Privacy
The Site is not directed to children under the age of thirteen, and we do not knowingly collect personal information from children. If we learn that we have inadvertently collected information from a child, we will delete it.
Changes to This Policy
We may update this Privacy Policy from time to time. The "Effective Date" above will reflect when the policy was last revised. Material changes will be communicated through a prominent notice on the Site. Continued use of the Site after a change indicates your acceptance of the revised policy.

The Site is provided for informational purposes about the Foundation, its mission, programs, governance, and grantmaking. You may view, share, and reference content from the Site for non-commercial purposes, with attribution. You may not use the Site in any way that violates applicable law, infringes the rights of others, or interferes with the Site's operation.
No Solicitation of Grant Applications
The Foundation is a private family foundation and does not accept unsolicited grant applications, letters of inquiry, or proposals. Information published on the Site, including descriptions of our programs and partners, does not constitute an invitation to apply for funding. Any unsolicited materials submitted to the Foundation may not be reviewed and will not establish any obligation on the part of the Foundation.
Information Is Not Advice
Content on the Site is provided for general informational purposes only. Nothing on the Site constitutes legal, financial, tax, investment, or professional advice. The Foundation is not a fiduciary to visitors of the Site, and use of the Site does not create any advisor-client, attorney-client, or fiduciary relationship.
Materials referencing the Foundation's investment policy, grantmaking practices, or financial figures are descriptive of the Foundation's own internal practices and should not be relied upon as guidance for any other party.
Intellectual Property
All content on the Site — including text, design, logos, marks, graphics, and code — is owned by the Foundation or its licensors and is protected by copyright, trademark, and other applicable laws. The name "The T. James Foundation," the foundation seal, and related marks are property of the Foundation. You may not use these marks without our prior written permission, except as required for fair-use commentary or news reporting.
Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, nor do we make any warranty regarding the accuracy, completeness, or reliability of any content. To the fullest extent permitted by law, the Foundation disclaims all warranties, express or implied.
Limitation of Liability
To the fullest extent permitted by law, the Foundation, its trustees, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if the Foundation has been advised of the possibility of such damages. The Foundation's total liability for any claim arising out of these Terms or the Site shall not exceed one hundred United States dollars (US$100).
Governing Law
These Terms of Use, the Privacy Policy, and any dispute arising out of or related to the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any legal action shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
Changes to Terms
We may revise these Terms of Use at any time by updating this page. The "Effective Date" above will reflect the latest revision. Material changes will be communicated through a prominent notice on the Site. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.
